Tasmanian AFL team: Victorian firm applies to register Tasmanian Devils Football Club trademark​



A painting company from regional Victoria has applied to trademark ‘Tasmanian Devils Football Club’, the early frontrunner for the name of our future AFL team.
The Mercury can reveal that Echuca Painting Pty Ltd applied to IP Australia on May 3 to trademark the name.

The company, owned by 55-year-old Echuca director Giovanni ‘John’ Molluso, has applied to register the trademark over Classes 25 and 41, relating to the manufacture of sporting goods including boots, uniforms and jerseys, and the organisation and promotion of sporting events.

The proposed trademark has been published and is awaiting indexing, meaning IP Australia officers are “identifying the elements that make up a trade mark,” according to the agency’s website.

When Echuca Painting was contacted by the Mercury, a man identifying himself as “John” answered, but said it was “probably his boss” – a different John – who registered the trademark.

He said he would pass on the Mercury’s details.

Intellectial property specialist Henry Jones, senior associate at Hobart law firm Dobson Mitchell Allport said he expected IP Australia would assess the application as “adverse... given there are already a couple of registered trademarks in that class”.

If IP Australia responded with an adverse report, Echuca Painting would be required to produce “evidence of use”.

“I expect they wouldn’t succeed, unless they can provide (that) evidence,” Mr Jones said.

If this evidence wasn’t provided, the trademark application would “eventually” lapse.

The Australian Football League currently holds 305 trademarks, analysis of the IP Australia database shows. Their trademarks include logos, the names of competitions such as Perth Footy League, and multiple variations on team names, such as Melbourne Demons, Melbourne Football Club, Melbourne Football Club MFC EST 1858, Melbourne FC, MFC, and MFC Melbourne.

The league has registered some trademarks relating to current Australian rules teams in Tasmania.

For instance, on May 16, 2019, the league filed for trademark over an image of a Tasmanian devil head emerging from a shield, bearing the words ‘Tasmania Devils’. This application remains under review, with an outcome due by July 08, 2023.

The logo is used by Tasmania Devils, the state’s representative junior club, owned by AFL Tasmania, that participates in the national Coates Talent League.

Registering a trademark in Australia costs a minimum of $250 and takes at least seven months, according to IP Australia.

Strongly suspect the "public vote" will give the AFL the result they want.

I think they should just call the team the Devils and be done with it. Mucking around with public polls and whatnot is just a waste of time and money, we know what the results will be.
Surely it’s already a given it will be the Devils. Voting or not I am confident of this. 👍
 
Has to be the Devils it's a no brainer was looking at Tasmanian Devils not long ago on YouTube they are ferious animals and cute too.

I remember the time we got Steele Sidebottom up on some poll for sporting name of the year.
