The ICC has also issued a warrant for Hamas leader Mohammed Deif, who Israel says they have killed.

According to the ICC, the chamber “found reasonable grounds to believe” that Deif was “responsible for the crimes against humanity of murder; extermination; torture; and rape and other form of sexual violence; as well as the war crimes of murder, cruel treatment, torture; taking hostages; outrages upon personal dignity; and rape and other form of sexual violence”.

It also said there were reasonable grounds to believe the crimes against humanity were “part of a widespread and systematic attack directed by Hamas and other armed groups against the civilian population of Israel”.

For Netanyahu and Gallant, who was replaced as defence minister earlier this month, the chamber “found reasonable grounds to believe” that they “each bear criminal responsibility for the following crimes as co-perpetrators for committing the acts jointly with others: the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts”.

It also found reasonable grounds to believe that “each bear criminal responsibility as civilian superiors for the war crime of intentionally directing an attack against the civilian population”.

That should hopefully put an absolute end to anyone in this thread trying to suggest the allegations of sexual violence against Hamas are the work of the Jewish lobby once and for all. Especially as the same ICC issued a warrant against Jewish Israelis Netanyahu & Gallant.

It won't. Israel could be nuked by Iran tomorrow and these people will claim it was an inside job false flag operation to make Iran look bad.

What makes you think they'd be any more or less effective against the Jewish lobby?

She's our Foreign Minister. Does she, and by extension do we, want to be on the right side of history or not? More importantly, will she sanction and impose other meaningful punitive restrictions on Israel, representing the will of the majority of Australians, or will she endlessly and apparently shamelessly continue to kowtow to the jew lobby / NewsCorp?

Why do you think anti-semitism is on the rise?

No. Is comprehension something other people do?

I don't think you do! 😂

Yep. So why the need to lobby as Jews? Why not just be Australians and let the Australian government govern for all of us?

You are so weak it's sad.

Not sure how you could come to this conclusion - Leibler is far from a "little group". As for other groups, their member's links to the powerful Israel and Jewish lobbies are well documented.

Where's the allegation (other than by the Jewish lobby) that the sexual violence was systematic?

Hmmmmm.

I do note that in the entire 13 months of war the ICC has determined a total of two occasions Israel had allegedly fired on civilians directly. Whoever's responsible for those two instances needs to be jailed for life.

The article linked in Kurve's sticky says they only considered the period from 8 October 2023, up to 20 May 2024. So not the entire 13 months at all.

The Chamber issued warrants of arrest for two individuals, Mr Benjamin Netanyahu and Mr Yoav Gallant, for crimes against humanity and war crimes committed from at least 8 October 2023 until at least 20 May 2024, the day the Prosecution filed the applications for warrants of arrest.

It also ruled on what Netanyahu and Gallant could be held responsible for, based on the material the Prosecution provided:

Chamber assessed that there are reasonable grounds to believe that Mr Netanyahu and Mr Gallant bear criminal responsibility as civilian superiors for the war crime of intentionally directing attacks against the civilian population of Gaza. In this regard, the Chamber found that the material provided by the Prosecution only allowed it to make findings on two incidents that qualified as attacks that were intentionally directed against civilians. Reasonable grounds to believe exist that Mr Netanyahu and Mr Gallant, despite having measures available to them to prevent or repress the commission of crimes or ensure the submittal of the matter to the competent authorities, failed to do so.

It would be quite likely that in the period following 20 May 2024 there would be more incidents that meet that bar.

There's also I'm sure a significant number of incidents that Netanyahu or Gallant wouldn't be held responsible for, but that the IDF have committed nonetheless.

Good. The sooner Israel gets rid of Likud the better. I guess they at least saved ICC some legal costs by nullifying the need of arrest warrants for Sinwar & Haniyeh.

This does fly in the face of claims made by many posters in here that Israel had been targeting mostly civilians in attacks for the entire 13 months of war. Glad that was at least cleared up by the ICC.
Not many claims IIRC that Israel was directly and intentionally targeting civilians. Rather, they don't care how many civilians they kill and make little or no effort to avoid civilian injuries and casualties.

Ok, So the ICC has found in that period there were a total of two attacks directed at civilians. That's still at odds with many posters in here claiming that Israel has been doing nothing but attacking civilians since the 8th of October last year. The ICC has found that nearly all attacks were directed against Hamas.

It also ruled on what Netanyahu and Gallant could be held responsible for, based on the material the Prosecution provided:
Yes, as I had said all along they're likely guilty of fighting a war of retribution disproportionately against the Hamas alliance and are doing so without doing anywhere near enough to meet their responsibilities in protecting innocent bystanders and their rights.

For that I am sure there will be enough evidence gathered by the ICC to convict both of these morons. This hopefully means they'll never govern Israel again.

Plenty have been posting that the whole war was pretty much directed at murdering Palestinian civilians in Gaza.

Yeah you can breathe easy man, they only knowingly caused two war crimes that people told the ICC about. Not as bad as it could have been, just a slap on the wrist really.

Israel still champions of peace

No. That was not what they found.

the Chamber found that the material provided by the Prosecution only allowed it to make findings on two incidents

Given the volume of the attacks made upon Gaza, I'd be pretty certain that not every single incident in the period 8/10/23 - 20/5/24 was provided to the ICC. They'd have provided a sample of the incidents, along with relevant documentation that would enable finding Netanyahu and/or Gallant responsible.

By no means does it mean the IDF haven't intentionally targeted civilians on other occasions in that time frame.

The ICC has found that nearly all attacks were directed against Hamas.

Source?

I think that may conflate a statement about broader systematic war crimes with specific crimes of a sexual/gender nature, but I'm not 100% sure. Will look again later.

No conflation.

Also, the warrants for Haniyeh and Sinwar were withdrawn due to their confirmed deaths otherwise, facing the same charges as Deif.

The warrant of arrest for Mr Deif is classified as ‘secret’ in order to protect witnesses and to safeguard the conduct of investigations. However, the Chamber decided to release the information below since conduct similar to that addressed in the warrant of arrest appears to be ongoing, in particular the holding of a number of hostages captive. The Chamber considers it is also in the interest of victims and their families to be aware of the warrant’s existence.

The Chamber found reasonable grounds to believe that Mr Deif, born in 1965, the highest commander of the military wing of Hamas (known as the al-Qassam Brigades) at the time of the alleged conduct, is responsible for the crimes against humanity of murder; extermination; torture; and rape and other form of sexual violence; as well as the war crimes of murder, cruel treatment, torture,; taking hostages; outrages upon personal dignity; and rape and other form of sexual violence.

The Chamber found reasonable grounds to believe that Mr Deif bears criminal responsibility for the aforementioned crimes for (i) having committed the acts jointly and through others and (ii) having ordered or induced the commission of the crimes, and (iii) for his failure to exercise proper control over forces under his effective command and control.

The Chamber found reasonable grounds to believe that during the relevant time, international humanitarian law related to international armed conflict (between Israel and Palestine) and non-international armed conflict (between Israel and Hamas) applied. The Chamber also found that there are reasonable grounds to believe that the crimes against humanity were part of a widespread and systematic attack directed by Hamas and other armed groups against the civilian population of Israel.

I would read this differently to how you seem to read it.

Note for those who will deliberately misinterpret or misrepresent my comment; I make no claim that there wasn't widespread or systematic sexual violence or rape.

So, even after death Deif's legacy is continued war crimes.

Sounds like there's witnesses in Gaza giving evidence against him. That pesky Jewish lobby at work again.

As I've been warning for some time now against demands for details of sexual violence, we're not going to get them. We're not entitled to them. The victims and witnesses names will be protected and the details suppressed, unless they decide to speak up.

The warrant of arrest for Mr Deif is classified as ‘secret’ in order to protect witnesses and to safeguard the conduct of investigations.

None of this appears to relate to my comment.

Yeah, same. It's definitely open for interpretation, and the reader cannot conclude that sexual / gender-based crimes were systematic, but rather war crimes were systematic.

This is the worst kind of cope

There might be Gazans as well to give evidence but to be sure, there will also be victims of rape/sexual violence and witnesses to, whose identities are suppressed.

If they ICC aren't claiming there's reasonable grounds that the rape he is responsible for was in some way systematic, why would it be included in war crimes charges against him? You don't get charged for the war crime of rape for being in the leadership of a military or terrorist organisation where sporadic rapes occurred but were not tolerated and perpetrators were punished. I don't think there is any other way to read that but that the ICC have reasonable grounds to believe it was at least systemic if not outright systematic. But they do explicitly say systematic.
