The Police Investigation
  • They originally thought they had gotten lost or run off together
  • Covid-19 limited the investigation to make inquiries
  • The lead investigator didn't get to the site until 8 months after they were "missing"
  • It was only in mid-2020 that they suspected murder
  • Hill's family sold his ute after Police returned it to them
  • In 2022 (after testing it multiple times), they found blood splatter and tissue on the canopy of the ute that DNA matched with Carol Clay
  • Back in June 2022, they ruled out the other 11 drivers that had gone through the number plate recognition cameras and were left with Lynn's 4WD
  • When they asked him about his movements in the Wonnangatta Valley, he was told he was a "person of interest" and not a suspect
  • They noticed the 4WD had been painted and Lynn said it was a lockdown activity he did with his kids
  • They had 5,000 recordings of Lynn talking to family member or himself in the home and car (including the one when he and his wife were watching 60 minutes)
  • They decided to arrest him because one of the secret recordings revealed that his wife was worried about being left alone with 3 kids and Lynn himself seemed depressed and possibly suicidal
Police Interview
  • They kept him for 3 days and had over 9 hours of interview footage, but only 5 hours were shown to the jury
  • Although his lawyer said he was truthful throughout, pre-trial revealed he refused to talk to Police for 2 days
  • When he decided to talk, he said it was against his solicitor's advice and due to him wanting to get resolution
  • He drew maps of the campsite and the location where the bodies were found
  • During pre-trial, Lynn's lawyer suggested that they hadn't done a required mental health assessment and had undermined the legal process - apparently it got quite testy
  • There was arguments in pre-trial about the PEACE method the Officers used (that has been criticised previously)
  • His lawyer wanted the whole interview thrown out due to a) how long it took (and that it was an attack on his right to silence), and b) that having the interview room set to freezing was an unfair tactic
Lynn's First Wife, Lisa
  • In pre-trial, the prosecutors floated calling her family to testify to Lynn's character and the nature of her death, reading out statements from her parents in the hearing
  • Lisa's mother blamed Lynn for the death, saying it was a "combination of fear and torture she lived under"
  • She also accused Lynn of ongoing physical and mental abuse
  • She referenced the incident of killing a neighbour's pet and also recounted an incident where he verbally went off at someone at the pub and then turned it onto Lisa when they got home
  • Lisa apparently kept a diary of when he was abusive and death threats that he had made towards her (and their children)
  • The judge agreed that they were prejudicial and couldn't be included in the trial
There was also some more information from someone that had known him much earlier on, but it's a bit irrelevant.
Thankyou MC BG, You have done us all a huge favor in posting this. It answers a lot of questions and highlights the pandora's box I was referring to. Someone within these forums had also made these claims re his past and his 1st wife and said that the truth would come out one day. Well the Karma King has perhaps been a part of this because if it weren't for the phone ping at Hotham and the Slug at Bucks Camp he would have walked it seems.

The jury had a motive for shooting Clay.

Like many, they would have had trouble believing someone who must have no priors, who's held a good job and trusted with the safety of hundreds of people, would for no reason at all, murder two people.

Well nothing that was admissible in court
 
Not if you believe GL's version. Hers was the first "accident".

For them to come up with motive for CC, they have to disbelieve the order of events - i.e. find him to be a liar.

If they accepted that he lied about the order of events, surely they should see the whole story as a fabrication?
I believe that the Jury considered the whole story to be a fabrication.

Much like the greater percentage of posters on this thread ;)

They couldn't prove beyond reasonable doubt that that Hill was murdered or even died as a result of Lynn's actions (manslaughter).

They possibly formed the view that Hill's death(from whatever reason) resulted in a series of events that cumulated in Clay being shot from beside the toilet tent.

That they found to be proven (asking for the ballistic evidence to be replayed suggests that they didn't believe she was cowering in fear, rather stalked and assassinated)

Lynn's post murder actions will be taken into account by the sentencing Judge when imposing sentence; I'd suggest this will be far in excess of an "ordinary" murder of one individual.

Appeal will be a free for all

They had the same witness and same testimony for both deaths

IMO he has a good chance of an appeal. This split verdict makes no sense. It’s beyond me how people cannot see that he’s guilty of two murders. Just madness.
 
If Dann got the interview thrown out that means they wouldn't be able to use the remains as evidence. The case against Lynn would have been non existent. Thankfully he wasn't successful in doing so.


Interesting he went against the advice of his appointed lawyer and spilled the beans. As good as Dann is there's no way he can undo that as he was advised by police that he didn't have to comment and his appointed lawyer also did the same.

Wow ... the judge nearly torpedoed the entire case by earlier ruling that post death behaviour of incriminating conduct by destroying evidence could only be made against charges such as manslaughter, not murder. That left the prosecution with the option of dropping the charges for murder and proceeding on manslaughter, or appealing the decision.

Ultimately this weird decision was successfully appealed by the defence.

For general deterrence, denunciation and the gravity of offending I would say he will get close to the maximum for his offences. I would also say his financial losses would be over a milion by the time he compensates all parties.
It’s only his family who will suffer. GL gets free board and food for probably or most of the rest of his life.
So much for him protecting his family.

I hope that this case brings changes to the law regarding deliberate and malicious destroying of evidence, especially human remains.

I think you’re applying the old fruit of the poisonous tree doctrine which would apply if the police committed some unlawful conduct around the interview. It appears the route defence took around the interview was the police overbore his will, in which case the interview could not be admitted but the drawings and maps were still admissible

Where is the evidence that Hill was murdered?

We know he probably suffered from cardio-vascular disease; hence the viagra usage

He might have died of a heart attack , stroke, a seizure or fainting fit and he hit his head in a fall when he was chatting to Lynn. about the weather.

Without an autopsy conducted on an entire body, no one will ever know of the means of his death

It is only Lynn's evidence that adds an altercation to the narrative
