Weiss sought special councel status from DOJ in Spring if 2022 and denied.

But then the prosecutors — based in Joe Biden’s home state of Delaware — are told in conversations with Hunter Biden’s lawyers if they file felony counts against Hunter for 2014 and 2015 they will be destroying their careers. These are career prosecutors — not political appointees — who are working at this point in the Biden Administration Department of Justice."
"Shapley does a very good job of laying out why HB’s handling of his Burisma income in 2014 was basic entry level tax evasion. HB was told he needed to amend his 2014 return, he needed to declare the money he received from Burisma that first went to another business, but he never did."
"He and Devon Archer each received $1 million a year from Burisma to serve on the Board. That worked out to $83,000 each per month. Burisma paid the money to Rosemont Senaca Bohai, LLC, a company Archer had set up in the US to use as an investment vehicle for money he received from Chinese partners. Hunter had his money from Burisma paid out to him by RSB, but had the paperwork showed the money he received to be a “loan” from RSB to him — not income. He did not include it on his tax return for 2014 when he got around to doing them, and he never paid back the “loan.”
"Shapley explained, this is about as garden-variety tax evasion as the IRS finds. Income gets paid to a third party, the third party then “loans” the money to the person who earned it, and that person then doesn’t repay the loan. There is no promissory note, no written terms for repayment, and no interest rate attached to the supposed “debt.” If it was truly a loan, there would be objective evidence confirming that was the case. This was the basis for the felony tax evasion charge for 2014."

The FBI never communicated with his Group the CHS information regarding a Burisma bribe of $5 million having been paid to Hunter and/or Joe Biden in the 2014-2015 time frame.
For 2016 - 2019 tax charges;

These agencies are very territorial, and defend their turf and the right to make their own decisions about how they do their work. It is much easier for DOJ to issue dictates down the chain within DOJ.

A Delaware assistant U.S. attorney, Lesley Wolf, was briefed in October 2020 that confidential human source (CHS) had reported Hunter and Joe Biden each received $5 million in bribes, Sen. Chuck Grassley revealed Sunday in a letter to Delaware U.S. Attorney David Weiss.
Grassley then highlighted the numerous ways Wolf appeared to have obstructed the investigation into Hunter Biden’s potentially criminal business activities.
“IRS whistleblowers have affirmed that AUSA Wolf prevented investigators from seeking information about Joe Biden’s involvement in Hunter Biden’s criminal business arrangements,” Grassley said, adding that she also “frustrated investigative efforts” by the IRS agents to question Hunter Biden’s business partner, Rob Walker, about Joe Biden.
