The ICC has also issued a warrant for Hamas leader Mohammed Deif, who Israel says they have killed.

According to the ICC, the chamber “found reasonable grounds to believe” that Deif was “responsible for the crimes against humanity of murder; extermination; torture; and rape and other form of sexual violence; as well as the war crimes of murder, cruel treatment, torture; taking hostages; outrages upon personal dignity; and rape and other form of sexual violence”.

It also said there were reasonable grounds to believe the crimes against humanity were “part of a widespread and systematic attack directed by Hamas and other armed groups against the civilian population of Israel”.

For Netanyahu and Gallant, who was replaced as defence minister earlier this month, the chamber “found reasonable grounds to believe” that they “each bear criminal responsibility for the following crimes as co-perpetrators for committing the acts jointly with others: the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts”.

It also found reasonable grounds to believe that “each bear criminal responsibility as civilian superiors for the war crime of intentionally directing an attack against the civilian population”.

Generally terrorist non-state actor, who are responsible for needlessly starting a war due to their genocidal ideology and susbequent mass atrocity, more liable than the state that defends itself from that threat. That's how sensible people think. None of it excuses war crimes on the behalf of the defending state. But if I have to choose who is responsible for the war, it's not even close. It's Hamas, then daylight, then Israel.

Never has a terrorist organisation been less accountable for their actions. Remember the UNGA 37/43 defense? Any means necessary, apparently. Poor little Hamas are justifiably committing a mass atrocity, they are a freedom fighting rape enabling organisation, what do you expect them to do when they break out of their open air prison, guys? So in this Jazny world, Israel are not responsible for the attrocities in The West Bank. Obviously all the killings, rapes and land stolen had nothing to do with any uprising on Oct 07.

This is without including keeping an entire city in an open air prison.

If we are telling one sided versions Arabs were massacring Jews long before the creation of Israel. The two people weren't getting along. A two state solution was proposed which the Jews accepted and arabs rejected and started a war they lost badly.

Palestinians were being slaughtered in their thousands, kicked out of their homes and villages (including on territory allocated for a future Palestinian state), and they expected neighbouring countries with close cultural ties to just sit and watch the refugees flood their countries?

Same could have been said about a next generation of Germans under Nazi rule. This is not only after the carpet bombing of Germany, but also with a campaign of mass rape against them from the USSR. This could easily have radicalised Germans. It didn't happen though. Have faith that the next generation of Palestinians in Gaza will correctly portion a large amount of the blame on Hamas and realise their terror tactics brought nothing but death and destruction on their people.
