Degoey’s last issue he was charged and the woman who made the allegation saw it through for more than 5 years.
On the day the case was to be heard the allegations were withdrawn.
That day.

I’m not gonna speculate cause thats all I’d be doing.
But the facts are she and the police took it to the steps of the court.
She never said he didnt do it.
He never said he didnt do it.

Get you're facts right. The Police opened the case, not her. JDG and the lady had settled their dispute. It didn't make it to the steps of courts because it was thrown out - they never would have gotten a guilty verdict.

It was for indecent assault. JDG was 18/19yo.

Its not slanderous that is how its been reported.
It was dropped the day of the trial

The 25-year-old told the club he was in a VIP area of the PHD rooftop bar in the Dream Hotel when women allegedly started taking drinks belonging to De Goey and his friend Luke Dyson, who was also charged.

The pair allegedly told the women to leave the area and were then challenged by their male friends, who allegedly began pushing and shoving the Australians, which led to De Goey throwing a punch in what he will claim was self-defence, before the people who had challenged them were thrown out of the Halloween party.

De Goey and Dyson were then arrested at approximately 2.33am after the friend of the person who had been struck contacted police on 911. De Goey then appeared in a New York court after spending the night locked up.

Before JDG was drafted were there any concerns raised regarding his behaviour etc? I assume not given he was such a high pick.

But it seems quite clear now that both Eddie and Buckley really didn't discipline JDG hard enough for his previous indiscretions, and couple with other off field cultural issues at the Pies like the bullying and abuse of Lumumba, irs pretty obvious that Collingwood had built up quite a toxic workplace since the 2010 flag, and probably why De Goey will be moved up by McRae and the new board and President.

Collingwood need a significant change in their playing culture and environment.

If its been such a toxic workplace for that long then why was even Adam Treloar was pleading to stay at the club since he loved working there so much?

I completely agree that Collingwood needed to make changes and implement all the recommendations from the Do Better report. But I think that in itself is evidence its not a toxic workplace. Collingwood's anti-racism Expert Group set up to have oversight of implementation of the recommendations is reporting no delays against the recommendation implementation timelines specified by the independent authors. If the workplace was toxic, then there is no way it would agree to put itself under such public scrutiny, let alone successfully implement all the recommendations.

As in, she and her lawyer (if she has one) do not press charges. The police / district attorney do that.

Now if she indicated she was not willing to testify and there was no other evidence, the police/DA may decide there is no chance of conviction (this is where the 'De Goey's high priced lawyer' comes in) and therefore drop the charges. The witness can't make that decision for them.

Also, IIRC you can't be sued for statements made as a court witness for defamation so what 'counterclaim' would she be subject to?

OK, but if an 'alleged victim' withdraws an allegation of a charge that has already been heard in court, this usually instigates the charge being dropped, that's plausible, not nonsense. Agree, police/the DA rarely pursue any charge if they don't have the support and/or testimony of the 'alleged victim'.

Related, the two main reasons the 'alleged victim' withdraws an allegation is; A. the offence did not occur or B. it did, but there is insignificant evidence to prove it. Again these are both plausible, not nonsense.

Also related, if the 'alleged victim' pursues an allegation but the related charge is dismissed by the court, then counterclaim's have almost become a formality in the US. Once again this is plausible, not nonsense.

One final thought - if Mr DeGoey had stupidly decided to legally represent himself in these matters, which he is entitled to do, I suggest we would be having a very different conversation now...

Devils advocate here but bottle service in a US nightclub is a heck of a culture shock. I was younger and far less financial than De Goey when I did it in the US. But pretty much you pay something like $600 for a bottle of vodka, whiskey, tequila whatever you want and then get your choice of mixers, ice, glasses etc all delivered to you at a table in a nightclub. I guess if you're lucky there's 30 shots in a bottle and so it's $20 a drink which isn't far off what they charge at the bar at these kind of places. Then you're sorted, no more going to the bar, no more mixing with the plebs, you get your VIP section and can party.

Except here comes the catch. You've got a waiter, a host, a bouncer to tip and look after so they look after you. And you'll have other people in or around the VIP area, hunting for an invite - formal or otherwise - to come get a drink with you. Your drink. Your $600 bottle. And it's a nightclub so it's not exactly the home of nice behaviour.

Sit by yourself for a while, don't tip anyone, don't invite any ladies or gentlemen to share drinking your bottle so you have to order the next one and suddenly the staff get a little bit antsy. Wander off to the dance floor or the toilets and they might not be watching your stuff so much. Especially if you're say - 2 young tourists dressed in bath robes, who have enough cash to buy a bottle but might not appear like they'll be running up a huge tab like a big entourage of people would.

You come back from powdering your nose in the toilets and suddenly some woman is drinking from your $600 bottle. You haven't tipped the bouncer all night and don't go do it now and get him to sort it, you try to sort it a more Australian way and you go to grab the drink from her and tell her to jog off. All of a sudden she's screaming accusations and her friends have jumped in and it's on for young and old.

Not to excuse the violence, nor should you try to live like a king if you don't understand the culture and the cost to do so, but I have a bit of a feeling how one thing can lead to another in this kind of situation.

Having previously lived in New York for 4 years a while ago, clubbed there and in other US cities, your comments are very relevant.

There are also a couple of related protocols that Mr. DeGoey and his mate would probably not have been aware of.

1. If you tip your security attendant and wait-person early, then you can pretty much get anyway with any behavioural nonsense and also leave your booth/VIP area at any time and no unauthorised persons (nominated by you) will not be allowed near it. However, if you 'don't tip', they simply assume their respective services are not required. A colleague of mine at a club in Atlanta stripped off down to his undies, then our security attendant politely advised him that if he removes those, he'll have no choice but to eject him from the club!

2. It's rare for most clubs in the US to allow less than 4 or 5 people to book/hire a VIP booth/area. For one thing how many bottles or other drinks are you going to sell 2 people vs 5..? Most clubs simply offer 'bottle service' over the bar if the 'group' is only 2 people. In the famous Club-54, which I never got into, it was a minimum of 6 people a booth. Perhaps our bogan Aussies claimed that other friends would be arriving to join them soon..?

3. In most clubs during my time there, they were ruthlessly preventing anyone walking around or going anywhere near the dance floor with a drink, be it bottle or glass. All drinks and related accessories stayed on the bar or on tables, even in VIP areas. Perhaps, again, our bogan Aussies were not aware of this rule and/or tried to push the envelope, and without also tipping their security attendant this would of annoyed him no end. You are also not allowed to take your bottle, not just from your VIP area, but also from the club, even if you are leaving. You drink it or you leave it!

4. I think they've stopped the practice now - but at some clubs they would deliver a gourmet platter of various dried fruits and assorted nuts, which most punters in VIP booths assumed were complimentary. They weren't and as I discovered in LA, it cost me $188 just because I grabbed a few cashew nuts..! Protocol was to politely wave them away before the tray hit the table, otherwise it was considered a sale.

Accordingly, given the above/conceivable misunderstandings and the fact at 2:30am everyone would of been off their face, 'an incident' involving our bogan Aussies was probably more likely than not...

Fortunately USA is not just NY. Pretty diverse place and folk. I spent some time in the secret south some years ago, mostly tracking some of the gothic black country scene, fantastic experience.
